Welcome to SoilSource Pty Ltd (SoilSource) identified with the Australian Business Number 60 691 425 340, a digital platform that connects construction companies with excess clean soil (VENM2/ENM3) to those seeking clean soil for reuse. References to “clean soil1” reflect descriptions provided by users and do not constitute verification or certification by SoilSource. SoilSource does not test, verify or certify whether any soil is clean, uncontaminated, asbestos free or compliant with any law or standard . Our Address is PO Box 738, Lane Cove NSW 1595. By accessing or using SoilSsource, you agree to the following Terms and Conditions.
1. Introduction
These Terms and Conditions apply to your use of this website and to any transactions relating to our products and services. By accessing or using this website, you agree to be bound by these Terms. You may also be subject to additional contracts relating to your relationship with us or any products or services you receive. If any provisions of those additional contracts conflict with these Terms, the provisions of the additional contracts will prevail to the extent of the inconsistency. These Terms are governed by the laws of New South Wales, Australia.
2. Scope of Services
SoilSource operates as an affiliate referral and digital marketplace facilitation service only. SoilSource connects soil suppliers and soil receivers by enabling the exchange of information through the platform. SoilSource does not act as a broker, agent, adviser, or representative of any user and is not a party to any transaction, agreement or arrangement between suppliers and receivers (including any payment for soil, transport, logistics or delivery).. SoilSource charges a connection fee to suppliers and receivers for introduction only. SoilSource does not receive payment for the soil itself.
SoilSource is not involved in, and has no responsibility for, any aspect of any transaction between users, including but not limited to:
- Negotiation of terms.
- Pricing or valuation..
- Contract formation..
- Payment arrangements..
- Transport, logistics or delivery..
- Compliance with laws or regulatory requirements..
- Performance or completion of any agreement.
All such matters are solely between the supplier and receiver.
3. No Advice or Recommendation
SoilSource does not provide advice, recommendations, opinions, or assurances of any kind, including in relation to geotechnical suitability, environmental compliance, regulatory approval, or fitness for any purpose. All decisions remain the sole responsibility of the users.
This includes (without limitation) any assurance that soil is uncontaminated, pollution free or asbestos free.
You must not rely solely on information obtained through the platform and must make your own independent enquiries, including obtaining professional advice where appropriate.
4. Platform Matching and Filtering
Any options presented on the platform are generated based on objective criteria such as location, availability, and information provided by users. Presentation of an option does not constitute a recommendation, endorsement, or assessment of suitability. SoilSource does not verify the accuracy or completes of information provided by users that is used in matching or filtering. Any matching, filtering, ranking or visibility of listings does not constitute advice, recommendation, prioritisation or assessment of suitability by SoilSource.
5. Geotechnical and Regulatory Responsibility
SoilSource does not assess, verify, test, or certify material properties, contamination status, asbestos status, compliance status or site conditions. Determining geotechnical suitability, environmental compliance, regulatory requirements, approvals, and lawful use of any material is the sole responsibility of the supplier and receiver. This includes whether any material is non-compliant or non-conforming with any applicable law, code, standard or regulatory requirement.
All information relating to soil, materials, classification, compliance, availability, quantity and location is provided solely by users and may be incomplete, inaccurate or misleading.
Users are solely responsible for compliance with all applicable laws and regulations, including environmental, waste, transport, planning and EPA requirements. SoilSource has no responsibility for, and disclaims all liability in connection with, any fines, penalties, notices, prosecutions or regulatory action arising from the conduct of any user.
6. Binding Agreement
By registering with, accessing, or using this website, you agree to be bound by these Terms and Conditions. Where applicable, we may require you to expressly accept these Terms, for example, by clicking “I agree” or similar confirmation during account creation or purchase processes. We take reasonable steps to ensure that these Terms are brought to your attention. If you do not agree to these Terms, you must not use this website or any services provided through it.

“Clean Soil”: In these terms, references to “clean soil” (including any reference to VENM or ENM) are used as descriptive labels only, reflecting how soil is described, classified or represented by the relevant supplier, generator, transporter or end user at any given time.
The term “clean” is not a regulated classification and is not intended to imply compliance with any Environmental Protection Authority (EPA) framework, order, exemption, guideline or statutory standard. SoilSource does not represent, warrant or guarantee that any soil is uncontaminated, free of pollutants, asbestos free, suitable for any particular use, or compliant with any legal or regulatory requirement. Determining the contamination status, classification, suitability and lawful use of any soil remains the sole responsibility of the supplier and/or receiving party, who must make their own enquiries and obtain independent professional advice where required. - VENM (Virgin Excavated Natural Material) refers to natural material such as clay, gravel, sand, soil, or rock fines that has been excavated from areas not contaminated with manufactured chemicals or process residues, and does not contain sulfidic ores or other waste. This definition is based on the NSW Environment Protection Authority (EPA) published on its website as of June 27, 2025
- ENM: Excavated Natural Material is defined as naturally occurring rock and soil (including but not limited to sandstone, shale, clay, and soil) that has been excavated from the ground, contains at least 98% (by weight) natural material, and does not meet the definition of Virgin Excavated Natural Material (VENM). ENM must not include material from contamination hotspots, processed material, or material containing asbestos, Acid Sulfate Soils (ASS), Potential Acid Sulfate Soils (PASS), or sulfidic ores. This definition is based on the NSW Environment Protection Authority (EPA)..
